Welcome to Shopibx! These Terms of Service (“Terms”) are a legally binding agreement between you (the “User”) and Shopibx, operated by Wobaly LLC (“we,” “us,” or “our”). By accessing, signing up for, or using any part of our platform, you agree to abide by these Terms. If you do not agree, please refrain from using our services.

1. Account Creation and User Eligibility

Eligibility:

  • Users must be at least 18 years of age.
  • By using our platform, you agree to comply with all applicable laws and these Terms.

Account Setup:

  • Users are required to provide accurate and complete registration information.
  • Misrepresentation during registration may result in account suspension or termination.

Account Security:

  • You are responsible for maintaining the confidentiality of your account credentials.
  • Unauthorized activity must be reported to us immediately.

2. Use of the Platform

Permitted Activities:

  • Users may utilize the platform for legitimate business purposes related to eCommerce.
  • You agree to upload only lawful, accurate, and non-infringing content.

Prohibited Activities:

  • Selling counterfeit, illegal, or restricted items.
  • Using the platform for fraudulent or deceptive practices.
  • Uploading malicious software, conducting phishing attempts, or other harmful behaviors.

Compliance with Laws:

  • Users must adhere to all relevant laws and regulations.
  • Non-compliance will lead to immediate account suspension.

3. Subscription Plans and Payments

Subscription Tiers:

  • Our plans vary by features, storage, templates, and user limits. Please review available plans before subscribing.

Free Trial:

  • We offer a 3-day free trial for evaluation purposes. Users must subscribe to a paid plan post-trial to continue access.

Billing and Renewal:

  • Subscription fees are billed monthly or annually, depending on the selected plan.
  • Failure to renew or update payment details may result in account suspension.

Non-Refundable Payments:

  • Payments made to Shopibx are final. Refunds are not issued, even for unused portions of your subscription.

Plan Downgrade:

  • Downgrading a plan may result in loss of features, data storage, or templates. Users are advised to back up important data prior to making changes.

4. Template Access and Use

Availability:

  • Templates are included in paid subscription plans.
  • An active subscription is required to activate and apply templates to your store.

Prohibited Use:

  • Templates cannot be resold, redistributed, or used outside the Shopibx platform.

5. Content Responsibility

  • Users can create and/or upload content to their stores and are solely responsible for ensuring compliance with copyright laws.
  • We do not monitor user-uploaded content but reserve the right to remove content that violates our Terms.

6. Shopibx’s Intellectual Property

  • Our content, including but not limited to logos, visual designs, trademarks, and platform features, is our exclusive property.
  • Users may not copy, reproduce, distribute, or modify our intellectual property without prior written consent.

7. User Feedback

  • By providing feedback or suggestions, you grant us the right to use, implement, or modify our platform based on your input without compensation or credit.

8. Promotions and Offers

  • We may offer promotional discounts or other special offers at our sole discretion.
  • These offers are subject to change and may include additional terms.

9. Refund Policy

  • All payments made to Shopibx are final.
  • No refunds will be issued, including for unused portions of a subscription.

10. Prohibited Items and Activities

  • Users may not sell illegal or counterfeit products through their stores.
  • Violations will result in account suspension or termination.

11. Termination and Suspension

Termination by User:

  • You may cancel your account at any time via your dashboard. No refunds will be issued for unused subscription time.

Termination by Shopibx:

  • We reserve the right to terminate accounts that violate our Terms, applicable laws, or harm other users.

Data Retention:

  • Following account closure, Shopibx may retain your data for a limited time as per applicable laws. After this period, all user data will be deleted.
